MCP Connector Terms
These terms govern the pagent MCP connector (the "Connector") — the endpoint that AI clients such as ChatGPT, Claude, or Codex use to reach pagent, a service of aihumin GmbH ("we," "us"). They govern only the Connector. Use of the pagent service itself is governed by the pagent Terms of Service, which you accept when you create a pagent account, and by any signed agreement between us; on any conflict, those documents prevail over these terms.
1. Without a pagent account
You may add the Connector to any AI client that supports the Model Context Protocol (MCP) without a pagent account. In that state the Connector can answer general questions about testing and experimentation — for example best practices from our testing knowledge base — and offer sign-in. Such answers are general information, not advice for your specific situation, and no guarantee of any testing outcome.
There is no entitlement to account-free answers: we may throttle or stop serving individual users or clients at our discretion — for example on excessive or automated use — without notice. All other features, including anything that reads or changes data or acts on a website, require a pagent account. Account-free use is a free-of-charge service provided as available: these terms apply to it from your first use of the Connector, no support or service level is provided, and we may discontinue it at any time.
2. Connecting a pagent account
The Connector becomes fully functional only after you authorize it against a pagent account. Authorization requires accepting the pagent Terms of Service; these terms supplement them for Connector-specific matters, and on any conflict the Terms of Service and any signed agreement prevail. The Connector can only see and do what the authorized user can already see and do in pagent; it never grants more access. What it can do is further limited by the permissions granted at authorization and your organization's connection settings in pagent, each checked on every call. Actions taken through the Connector are recorded like any other account activity and count toward your plan's usage limits. You can revoke the connection at any time in pagent or in your AI client.
3. Your AI client acts for you
Your AI client and its model provider are third parties with their own terms and privacy practices; we do not control them. Requests the Connector receives from your client are treated as your instructions. You are responsible for reviewing actions your client proposes — including actions that affect experiments running on a live website — before approving them.
4. Data
To operate the Connector we process the requests and responses exchanged with your AI client, together with the technical and usage metadata needed to secure, rate-limit, and account for the service. We do not collect your conversation with your AI client beyond the tool calls it sends us, and we do not use content passing through the Connector to train AI models or permit our subprocessors to do so. Our handling of personal data is described in the pagent Privacy Policy. Once data is returned to your AI client it leaves our control; from that point it is governed by your agreement with that provider.
5. Acceptable use
Do not use the Connector to break the law, access accounts or data without authorization, probe or disrupt the service, or exceed the permissions you were granted. We may suspend a connection to protect users or the service.
6. Changes, previews, and availability
We may change, suspend, or discontinue the Connector or its tools, and may rate-limit or suspend a connection to protect the service. Tools labeled beta, preview, or experimental are provided for evaluation and may change or be withdrawn without notice. No availability commitment or service level applies to the Connector unless a signed agreement between us says otherwise. Knowledge-base answers (Section 1) are general information; we do not warrant their accuracy or fitness for your specific situation.
7. Liability
We are liable without limitation for injury to life, body, or health, for intent and gross negligence, under the German Product Liability Act, for fraudulent concealment, and under guarantees we have given.
For use free of charge — including account-free use under Section 1 — our liability is limited to the cases in the previous paragraph.
Otherwise, we are liable only for the slightly negligent breach of an essential contractual obligation — an obligation whose fulfillment makes the proper performance of these terms possible in the first place and on whose observance you may regularly rely — limited to the foreseeable damage typical for this kind of service and capped at the fees you have paid for the pagent service in connection with which the claim arises in the twelve (12) months preceding the event giving rise to the claim. Any further liability is excluded.
For loss of data we are liable only to the extent the loss would also have occurred with proper, state-of-the-art data backups on your side. Claims under this section, other than under its first paragraph, become time-barred one year after the statutory start of the limitation period.
8. General
The Connector is offered to businesses only, not to consumers. By using it you confirm that you act in the exercise of your trade, business, or profession.
These terms, and any dispute arising out of or in connection with them, are governed by the laws of the Federal Republic of Germany, excluding its conflict of law provisions and the UN Convention on Contracts for the International Sale of Goods (CISG). To the extent legally permissible, the courts of Bonn, Germany, have exclusive jurisdiction over any dispute arising out of these terms. We remain entitled to bring proceedings at your general place of jurisdiction.
We may amend these terms with effect for the future where changes to the Connector, the law, or the technical environment justify it; amendments to fees or to essential features of a paid connection require your active consent. We will announce amendments at least four (4) weeks before they take effect on this page and, for connected accounts, in text form. If you do not object within four weeks of the announcement, the amended terms are deemed accepted; the announcement will point out this consequence. If you object, either party may end the connection.
If a provision of these terms is or becomes invalid, the remaining provisions stay unaffected.
